WATER SERVICE AGREEMENT <br /> For and in consideration of the undertakings and covenants set out herein, it is agreed by <br /> and between the Owner(s) of the premises described at paragraph 8 hereof, and which person or <br /> persons are signatory hereto, ("Owner"), and TI� CITY OF DECATUR, II,LINOIS, ("city"), as <br /> follows: <br /> l. The provisions of this Agreement, and the installation, operation and use of the <br /> water service authorized hereby, are expressly made subject to all applicable provisions of codes, <br /> ordinances, rules and regulations of City, and Owner agrees to comply therewith. <br /> 2. After completion of the construction of a watermain by the City in the street or <br /> roadway adjacent to the premises described herein, and upon obtaining a tapping permit in the <br /> customary manner followed by the City for premises within its corporate limits, Owner may tap <br /> said watermain of City and connect a water service thereto to furnish residential service only to <br /> said premises. <br /> 3. Said tap, connection and service sha11 be made and installed by a licensed plumber. <br /> 4. The water furnished by City shall only be used for domestic purposes and only <br /> upon the premises described herein. <br /> 5. At such time as said premises become contiguous to the corporate limits of City, <br /> the then owner of said premises sha11, within ninety (90) days after receiving notice from City <br /> thereof, petition to annex the same to the City. <br /> 6. This Agreement shall terminate upon the failure by Owner to comply with any <br /> provision hereof or with any applicable provision of City Code, ordinances, rules or regulations, <br /> or upon the annexation of said premises to the City, and may be ternunated by either party upon <br /> six (6) months notice by certified mail to the other, addressed to One ary K. i�nderson Piaza, <br /> Decatur, Dlinois, if to the City or to � if to the <br /> Owner. <br /> 7. This Agreement is intended for the benefit of said premises as well as the current <br /> owner and occupant thereof and to said end shall be binding upon and inure to the benefit of said <br /> owner and his successors in title. <br />
