Newell, Traffic Engineer �{«. <br /> SUBJECT: Proposed Easement to Caterpillar Inc. for <br /> Maintenance of an Existing Fence Along 27th Street <br /> An item on the agenda for the meeting of Monday, July 1, 1996, is a resolution authorizing <br /> the establishment of a permanent easement along the east side of 27th Street adjacent to <br /> Caterpillar Inc. to accommodate the facility's existing perimeter fence. <br /> Portions of Caterpillar's existing perimeter fence, adjacent to 27th Street, encroach on City <br /> right-of-way. The proposed permanent easement attached hereto would allow the occupancy and <br /> maintenance of the existing fence where any encroachments occur. <br /> Caterpillar recently completed a survey of its perimeter fence to deternune the location of the <br /> fence with respect to existing 27th Street right-of-way. The survey indicated that portions of the <br /> fence encroach on the right-of-way. City Staff has spent considerable time on reviewing this <br /> survey and other research. It appears that the confusion regarding the right-of-way limits is a <br /> result of a historic surveying error which occurred prior to or concurrent with the construction of <br /> the fence. <br /> It is the objective of City Staff and Caterpillar Inc. to accommodate the fence in its existing <br /> location. Staff sees no justification for relocating all or portions of the e�sting fence. The <br /> existing fence has been in place for many years and there have been no problems with the cunent <br /> location. <br /> Caterpillar Inc. recently conveyed an easement to the City to provide for the maintenance of <br /> the improved traffic signals located at the intersection of Pershing Road and 27th Street. <br /> Staff recommends the approval of the permanent easement, and will be present at the meeting <br /> to answer any questions the City Council may have. <br />
