C � 1 , . • r AGREEMENT � � This agreement, entered into this �� ' day of A.D. 1996• by and between the City of Decatur, in Macon County, of the State of I linois, hereinafter called the CI1'Y, Hickory Point Township, in Macon County, of the State of Illinois, hereinafter called the TOWNSHIP, and Macon County, of the State of Illinois, hereinafter called the COUNTY. WITNESSETH: WHEREAS, the ABOVE PARTIES, in order to facilitate the free flow of traffic and insure the safety of the motoring public are desirous of improving the intersection of Mound Road and MacArthur. . WHEREAS, the intersection is the jurisdiction of the COUNTY and CI1'Y; and WHEREAS, the intersection is within the corporate limits of the CI'TY; and WHEREAS, the improvements to the intersection shall consist of installing traffic signals which shall include detector loops, controller, controller cabinet, post, mast arms, combination mast arms, signal heads; and all other work necessary to complete the improvement in accordance with the approved plans and specifications; and WHEREAS, the COUNTY, TOWNSHIP, and CITY are desirous of said improvement to the intersection which will be of immediate benefit to both the COUNTY, TOWNSHIP, and CITY residents and permanent in nature; NOW THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The CITY agrees to make the surveys, obtain all necessary rights of way, prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improvement to be built in accordance with the plans, specifications and contract. 2. The CITY agrees to pay all rights-of-way, construction and engineering costs, subject to reimbursement by the COUNTY as hereinafter stipulated. 1
