Route 710 <br /> Section SOR-I <br /> Macon County <br /> Contract No. 90798 <br /> C-95-136-95 <br /> Agreement No. JN-596016 <br /> AGREEMENT <br /> This agreement, entered into this ��� day of , A.D. 19� by <br /> and between the STATE OF ILLINOIS, acting by and through its D PARTMENT OF <br /> TRAN5PORTATION hereinafter called the STATE, and the City of Decatur, in Macon <br /> County, of the State of Illinois, hereinafter called the CITY, and Macon County, of the State <br /> of Illinois, hereinafter called the COUNTY. <br /> WITNESSETH: <br /> WHEREAS, the STATE in order to facilitate the free flow of traffic and insure safety <br /> to the motoring public, is desirous of improving approximately 1,540.6 kilometers (5,045 ft.) <br /> of Bloomington Road (F.A.P. Route 710/U.S. Business 51), including improving its <br /> intersection with Mound Road (F.A.U. Route 7359). Improvements to the Mound Road <br /> intersection shall include removing existing median islands, constructing a right-turn lane on <br /> southbound Bloomington Road and modernizing the existing traffic signal system. <br /> Improvements to northbound and southbound Bloomington Road shall include patching the <br /> existing concrete pavement, resurfacing all lanes with 25 millimeters (1 in.) of Leveling <br /> Binder and 38 millimeters (1'h in.) of Bituminous Surface Course-Mixture E and by <br /> performing all other work necessary to complete the improvements in accordance with the <br /> approved plans and specifications; and <br /> WHEREAS, the COUNTY and CITY are desirous of said improvements in that same <br /> will be of immediate benefit to both the COUNTY and CITY residents and permanent in <br /> nature; <br /> NOW, THEREFORE, in consideration of the mutual covenants contained herein, the <br /> parties hereto agree as follows: <br /> 1. The STATE agrees to make the surveys, obtain all necessary rights of way, prepare <br /> plans and specifications, receive bids and award the contract, furnish engineering <br /> inspection during construction and cause the improvement to be built in accordance <br /> with the plans, specifications and contract. <br /> 2. The STATE agrees to pay all rights-of-way, construction and engineering costs, subject <br /> to reimbursement by the COUNTY as hereinafter stipulated. <br /> . -1- <br />
