ORDINANCE NO. 2 01 6—4 9 <br /> ORDINANCE AMENDING CITY CODE <br /> -CHAPTER 47- <br /> -CONTROL OF ANIMALS,FOWL AND DOGS— <br /> WHEREAS,the City of Decatur is a home rule unit of local government with authority to <br /> legislate in matters concerning its local government and affairs; and <br /> WHEREAS, under its home rule authority, the City may enact ordinances to control <br /> animals and regulate and limit the intensity of uses of lot areas and open spaces compatible with <br /> the character of the Zoning Ordinance within the City of Decatur; and <br /> WHEREAS, it is in the best interests of health, safety and welfare of the citizens to <br /> regulate control of animals, fowl and dogs. <br /> NOW THERFORE,BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY <br /> OF DECATUR,ILLINOIS: <br /> Section 1. That Chapter 47 of the City Code of the City of Decatur, Illinois, be, and the <br /> same is hereby modified and amended by amending Section 3, so that Section 3 as so modified <br /> and amended, shall provide as follows: <br /> 3. FARM ANIMALS PROHIBITED.No person, firm or corporation shall <br /> keep any cattle, sheep, swine, or goats at any place upon any premises within the City <br /> except temporarily in stock yards for sale or shipment and except temporarily in <br /> packing plants for slaughter. The minimum lot area for keeping a horse or animal of the <br /> equine family is one (1)acre for one equine and one (1)additional acre for each <br /> additional equine and in no case shall an equine be kept unless one (1)twelve foot by <br /> twelve foot stall enclosed with three (3) solid walls is provided for sheltering each equine <br /> kept on such lot. Lots and shelters must comply with all City of Decatur ordinances. No <br /> part of the shelter shall be within 75 feet of any dwelling house occupied by human <br /> beings, except any dwelling house occupied by the owner or person in control of said <br /> equine(s). <br /> Section 2. That the City Clerk be, and she is hereby, authorized and directed to cause the <br /> provisions hereof to be appropriately set out in the City Code and to cause the same to be published in <br /> pamphlet form according to law. <br />
