STAFF REPORT �: ���� �,���m ��� <br /> Decatur City Plan Commission <br /> COMMON NAME: City of Decatur Zoning Ordinance <br /> GENERAL INFORMATION <br /> Hearing Date May 5, 2016 <br /> Calendar No. 16-12 <br /> Requested Action Amendments to Zoning Ordinance (Ordinance#3512) <br /> Petitioner Billy Tyus, Assistant City Manager <br /> BACKGROUND <br /> The current City of Decatur Zoning Ordinance was adopted in May of 2002. Since the time of adoption, <br /> Sta.ff has discovered certain necessary changes, discrepancies and omissions as the new ordinance has <br /> been implexnented, specifically in SECTION II. Definitions, SECTION XII. B-2 Commercial District, <br /> SECTION XIV. B-4 Central Business District, and SECTION XVI. M-1 Intense Commercial/Light <br /> Industrial District. It is Staff's hope that these changes and clarifications will make the Zoning <br /> Ordinance more comprehensive and applicable to the changing built urban environment all the while <br /> keeping the charge of making Decatur a beautiful place to live,work and play. <br /> The proposed amendments will make clarifications in definitions and where automobile and truck <br /> rental businesses can be located within the City of Decatur. <br /> DESCRIPTION <br /> One of the proposed amendments is to clarify the definition of Rental Establishments as well as <br /> create definitions for Rental, Passenger Automobiles, Passenger Trucks and Passenger Vans, Rental, <br /> Trucks and Trailers and Intermodal Storage Containers. <br /> The proposed amendments to the B-2 Commercial District, B-4 Central Business District and M-1 <br /> Intense CommerciaULight Industrial District involve permitting Passenger Automobile, Passenger <br /> Truck and Passenger Van Rental businesses in the B-2 Commercial District and the M-1 Intense <br /> Commercial/Light Industrial District. The proposed amendments will also permit Truck and Trailer <br /> Rental businesses in the M-1 Intense CommerciaULight Industrial District. The B-4 Central Business <br /> District currently allows a conditional use permit for Auto and truck rental, the proposed amendments <br /> will clarify that a conditional use permit could be obtained for Passenger Automobile, Passenger <br /> Truck and Passenger Van Rental businesses. <br /> STAFF RECOMMENDATION <br /> Staff recommends approval of the amendments as proposed. <br /> PLAN COMMISSION ACTION <br /> Section XXIX.G. of the Zoning Ordinance requires the Plan Commission to hold a public hearing and <br /> make recommendations to the City Council on amendments to the Zoning Ordinance. A motion to <br /> forward Calendar Nunnber 16-12 to City Council with a recommendation of approval is suggested. <br /> The above report constitutes the testimony and recommendation of the Division of Planning and <br /> Sustainabiliiy, Department of Planning and Building Services, City of Decatur. <br /> Suzan Stickle <br /> Senior Planner <br />
