� � <br /> hardware, or the limited life expectancy and integrity of the disk and its <br /> contents for which Engineer bears no responsibility. <br /> (g) Compliance With Laws <br /> To the extent they apply to its employees or its services, Engineer shall <br /> comply with all applicable United States, state, tenitorial and commonwealth <br /> laws, including ordinances of any political subdivisions or agencies of the <br /> United States, any state, territory, or commonwealth thereof. <br /> (h) Indemnification <br /> Engineer shall indemnify and hold harmless Client up to the amount <br /> of the compensation paid by Client to Engineer for its services rendered <br /> under this Agreement (excluding costs and subcontract expenses from Client's <br /> loss or expense) including reasonable attorneys' fees, for claims for personal <br /> injury (including death) or property damage arising out of the sole negligent <br /> act, enor or omission of Engineer. <br /> Client shall indemnify and hold harniless Engineer, up to the same <br /> amount that Engineer undertakes to indemnify the Client under this <br /> Agreement, from loss or expense, including reasonable attorneys' fees, for <br /> claims for personal injuries (including death) or property damage arising out <br /> of the sole negligent act, error or omission of Client. <br /> In the event of joint or concurrent negligence of Engineer and Client, <br /> each shall bear that portion of the loss or expense that its share of the joint <br /> 10/28/94 HES STD AGMT 2 -7- <br /> i <br /> TJ7103.AG1 <br />
