Couter, Corporation Counsel <br /> RE: Abandoned Mobile Homes <br /> Illinois law provides that cities may appoint agents to dispose of abandoned mobile homes <br /> located in mobile home parks. These agents may be the owners of the parks where the abandoned <br /> mobile homes are located. The disposal process consists of notice to the record owners of the <br /> abandoned mobile homes, public sales, etc. By law, the city has immunity from any liability for the <br /> removal of these mobile homes. <br /> Garfield Estates, a partnership, has asked that it be appointed as the City's agent to remove <br /> abandoned mobile homes from its mobile home park located at 3611 East Garfield Avenue. It has <br /> agreed to indemnify and hold harmless the City for its actions, adding to the immunity from liability <br /> provided by statute. Given that abandoned mobile homes can be a problem for public health and <br /> safety, staff feels that the appointment of Garfield Estates is an appropriate way to address the <br /> problem. <br /> Staff recommends approval of the resolution authorizing Garfield Estates to act as the City's <br /> agent, as described above. <br /> JWC:ps <br /> cc: Wendy L.
