a '
f
 . .
` LEGAL DEPARTMENT MEMORANDUM
NO. 95-22
November 2, 1995
TO: Honorable Mayor and City Council Members
FROM: James C. Bacon, Jr., City Manager
John W. Couter, Corporation Counsel
RE: Abandoned Mobile Homes
Illinois law provides that cities may appoint agents to dispose of abandoned mobile homes
located in mobile home parks. These agents may be the owners of the parks where the abandoned
mobile homes are located. The disposal process consists of notice to the record owners of the
abandoned mobile homes, public sales, etc. By law, the city has immunity from any liability for the
removal of these mobile homes.
Garfield Estates, a partnership, has asked that it be appointed as the City's agent to remove
abandoned mobile homes from its mobile home park located at 3611 East Garfield Avenue. It has
agreed to indemnify and hold harmless the City for its actions, adding to the immunity from liability
provided by statute. Given that abandoned mobile homes can be a problem for public health and
safety, staff feels that the appointment of Garfield Estates is an appropriate way to address the
problem.
Staff recommends approval of the resolution authorizing Garfield Estates to act as the City's
agent, as described above.
JWC:ps
cc: Wendy L. Morthland
John T. Robinson
