/ � 1 <br /> a. The OWNERS shall promptly furnish CI�D with a <br /> commitment for an owner' s title insurance policy insuring against <br /> defects in merchantability of title in the value of the purchase <br /> price. Title evidence shall show that there are no financing <br /> statements on file affecting the premises . Title may be subject to <br /> mineral rights if reserved or conveyed of record and to all <br /> easements and building and use restrictions now of record which do <br /> not restrict reasonable use. CICD shall promptly advise the OwNERS <br /> of any claimed defects in title evidence to permit a resolution of <br /> the same before closing. The OWNERS shall pay the initial search <br /> charge and the title insurance premium charge and CICD shall pay <br /> the search charge as to CICD and the cost of any mortgage title <br /> insurance policy if any, and the cost of any endorsements which <br /> CICD may rec�uest be attached to said policy. <br /> b. CICD shall pay the OWNERS the balance of the <br /> purchase price at the office of First of America Trust Company on <br /> the closing hereinabove specified. <br /> c. At closing the OWNERS shall pay for transfer tax <br /> stamps and shall pay- for or give CICD credit for general real <br /> estate taxes for all prior years and for the OwNERS' prorata share <br /> of such taxes for the year in which the closing occurs. The OWNERS <br /> shall further pay or give CICD credit for any special assessments <br /> which are a lien against the premises. Credit for general real <br /> estate taxes shall be computed on the basis of the most current tax <br /> information available at the time of closing. <br /> d. The sale shall be of the real estate in an "as is" <br /> condition and the parties expressly agree that the OWNERS and their <br /> agents have made no representations, warranties or guarantees <br /> concerning the condition of the premises or specifically the <br /> condition of the plumbing, electrical, heating, air conditioning or <br /> other mechanical systems or appliances and no representations have <br /> been made concerning the water supply, sewe�, sewage disposal <br /> systems, roof or structural soundness of the improvements upon the <br /> premises. No notices of suits or judgments relating to violations <br /> at the premises of zoning, fire, air pollution or health laws and <br /> -5- <br />
