� <br /> � � � � - , 33 <br /> .. <br /> . . � , . <br /> • • AGREEMENT <br /> THIS AGREEMENT, between the City of Decatur, Illinois, a <br /> Municipal Corporation, (hereinafter "City" ) and Airport Plaza <br /> i Joint Venture (herei�after "Developer" ) , sets forth certain <br /> responsibilities of each party for construction of certain <br /> roadway improvements to be made in conjunction with development <br /> of a portion of Airport Plaza Addition to the City of Decatur. <br /> RECITALS: <br /> WHEREAS , Developer is the beneficial owner of Soy Capital <br /> Bank and Trust Company Land Trust No. 8043 under Trust Agreement <br /> dated April l, 1994, which Trust owns Lots 2, 3 and 4 of Airport <br /> Plaza Addition; and <br /> WHEREAS, Developer has submitted through its engineer, Homer <br /> L. Chastain and Associates, plans for roadway and site <br /> improvements to be constructed on and adjacent to Lots 1, 2, 3 <br /> and 4 of said Addition, and; <br /> WHEREAS, the City of Decatur has agreed to share in the cost <br /> of certain roadway improvements which will benefit the public. <br /> � WITNESSETH: <br /> THEREFORE, in consideration of the mutual promises set forth <br /> herein, the parties agree as follows: <br /> ( 1) Developer agrees to widen and install acceleration <br /> and deceleration lanes for Illinois Route 36 at the intersection <br /> of 36 and the proposed Airport Plaza Drive to be located at the <br />
