The City shall <br /> pay all costs of said installation for which Developer is not <br /> liable. <br /> ( 4) City shall secure, if necessary,. e��her by private <br /> conveyance, or by eminent domain proceedings, sueh additional <br /> right of way conveyances or easements along the South side of <br /> Maryland S�reet as may be required for completion of the roadway <br /> improvements, with the cost of such right of way acquisition to <br /> be part of the construction costs shared by Developer and City as <br /> apportioned in paragraph 2. <br /> ( 5) Developer agrees that all improvements shall be <br /> constructed in accordance with the plans and specifications <br /> submitted to and approved by the City of Decatur. <br /> _.
