During the pe'rformance of this contract, the <br /> contractor agrees as folloWs: ' <br /> (1) That it �rill not discriminate against any emplo.yee or applicant f or <br /> . employment because of �race. color, religion. � sex, marital status, national <br /> origin or ancestry, age, physical or mental handicap unreiated to ability, or an <br /> unfavorable discharge from military service; and further that it uill examine <br /> all job classifications to determine if minority persons or uomen are <br /> , underutilized and uill take appropriate affirmative action to rectify any such <br /> ' underutilization. <br />' �2) That, if it hires additional employees in order to perform this <br /> contract or any portion thereof, it uill determine the availability (in <br /> accordznce uith the Department's Rules and Regulations) of minorities and vomen <br /> in the area(s) from vhich it may reasonably recruit and it irill hire for each <br /> job classification for �ahich employees are hized in sUch a c�ay that minorities <br /> and vomen are not underutilized. <br /> (3} That, ,in all solicitations or advertisements for employees placed by <br /> it or on its behalf. it crill state that all applicants �.-ill be afforded equal <br /> opportunity �.Zthout discrimination because of race, color� religion, sex, <br /> marital status, national origin or ancestry, age, physical or mental handicap <br /> unrelated to ability, or an unfavorable discharge from military service. <br /> ' e resentative of <br /> (4) That it t.ill send to each labor organization or -r p <br /> vorkers uith �hich it has or is bound by a collective bargaining or other <br /> zgree�ent or understanding, a notice advising such labor organization or <br /> � re resentative actor's obli ations under the Illinois Human RighLs <br />� P of the contr 8 <br /> Act and the Department's Rules and Regulations. If any such labor organization <br /> or representative fails or refuses to cooperate �:ith the conLractor in its <br /> efforts to comply vith such Act and Rules and Regulations, the contracior uill <br /> promptly so notify the Department and the contracting agency and vill recruit <br /> employees from o[her sources 4hen necessary to fulfill its obligations <br /> thereunder. <br /> (5) That it uill submit reports as required by the Department�s Rules and <br /> Regulations, furnish all relevant inforaation as nay from time to tine be <br /> requested by the DeparLmen� or the contracting agency, and in all respects <br /> comply vith the Illinois Huaan Rights Act and the Department's Rules and <br /> Regulations. <br /> (6) ?hzt it �:ill pernit access to all relevant books, records, accounts <br /> and uork sites by personnel of the contrzcLing agency and the Pepartmenc for <br /> purposes of in��esti�ation to ascertain compliance uith the Illinois Human Rights <br /> act and the Departmen['s Rules and Regulations. <br /> • �i) That it uill include verbacim or by reference the provisions of this <br /> clause in every subcontract it awards under vhich any portion of the contract <br /> obligations are undertaken or assuaed� so that such pro�isions �:ill be� binding <br /> upon such cor.cractor.
