RECIPIENT AGREEMENT <br /> THIS AGREEMENT, entered this 5th day of June, 1995 by and between <br /> the City of Decatur, Illinois (herein called the "City") and Boys <br /> and Girls Club of Decatur (herein called the "Recipient") . <br /> WHEREAS, the Recipient has requested funds from the City; and <br /> WHEREAS, the City wishes to provide funds to the Recipient; <br /> NOW, THEREFORE, it is agreed between the parties hereto that the <br /> Recipient will be responsible for administering fiscal year <br /> 1995/96 funds for the 1995 Phoenix Park and Boys and Girls Club <br /> of Decatur Summer Program. <br /> I . TIME OF PERFORMANCE <br /> The term of this Agreement and the provisions herein shall <br /> end at the completion of the fiscal year, namely April 26, 1996 . <br /> II . PAYMENT <br /> It is expressly agreed and understood that the total amount <br /> to be paid by the City under this Agreement shall not exceed <br /> $25, 000 . 00 . <br /> III . Independent Contractor <br /> Nothing contained in this Agreement is intended to, or shall <br /> be construed in any manner, as creating or establishing the <br /> relationship of employer/employee between the parties . The <br /> Recipient shall at all times remain as independent contractor <br /> with respect to the services to be performed under this Agree- <br /> ment . The City shall be exempt from payment of all unemployment <br /> compensation, FICA, retirement, life and/or medical insurance and <br /> workers' compensation insurance as the Recipient is an independ- <br /> ent Recipient. <br /> 1 <br />
