RESOLUTION NO. R�5—S�� RESOLUTION REQUESTING TEMPORARY CLOSING OF A PORTION OF LAKE SHORE DRIVE - MEMORIAL DAY WEEKEND - WHEREAS, SummerStart, Inc. is sponsoring a festival in the City of Decatur, which event constitutes a public purpose; and, WHEREAS, this festival will require the temporary closure of Lake Shore Drive, a State Highway in the City of Decatur, from South 16th Street to East Cantrell Street; and, WI�REAS, Section 4-408 of the Illinois Highway Code, (605 ILCS 5/1-101 et seq.), authorizes the State of Illinois Department of Transportation to issue permits to local authorities to temporarily close portions of State Highways for such public purposes. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That permission to close off Lake Shore Drive from South 16th Street to East Cantrell Street, as above designated, be requested of the Department of Transportation. Section 2. That this closing shall occur during the approximate time period between 10:00 P.M. on Friday, May 26, through 6:00 A.M. on Tuesday, May 30, 1995. Section 3. That this closure is for the public purpose of a community festival. Section 4. That traffic from the closed portion of highway sha11 be detoured over routes with an all weather surface that can accept that anticipated traffic, which will be maintained to the satisfaction of the Department and which is conspicuously marked for the benefit of traffic diverted from the State Highway. Section 5. That the City of Decatur assumes full responsibility for the direction, protection and regulation of the traffic during the time the detour is in effect. Section 6. That all debris shall be removed by the City of Decatur prior to reopening the State Highway. Section 7. That the closure and detour shall be marked according to the Illinois Manual on LTniform Ti•affic Controi Devices. Section 8. That the City of Decatur hereby agrees to assume all liabilities and pay all claims for any damage which shall be occasioned by the closing described above. Section 9. That a copy of this Resolution be forwarded to the Department of Transportation to serve as a formal request for the pernussion sought in this Resolution and to operate as part of the conditions of said permission.
