PRELIMINARY TRANSPORTATION PLANNING AND <br /> ENGINEERING SERVICES AGREEMENT <br /> THIS AGREEMENT, made and entered into this�ay of 95, <br /> by and between the City of Decatur,a body corporate and politic of the State f Illinois, <br /> hereinafter referred to as the "Owner",and Bucher,Willis &Ratliff,Consulting Engineers, <br /> Planners & Architects, with offices located at 75 Executive Drive, Suite 103, Aurora, <br /> Illinois,hereinafter referred to as the "Consultant". <br /> WITNESSETH: <br /> TNHEREAS, the Owner desires to have the Consultant provide transportation planning <br /> and engineering services for the Lake Shore Drive Relocation Feasibility Study,hereinafter <br /> referred to as the "Project". <br /> WHEIZEAS, the Owner has selected the Consultant to perform the services as described <br /> herein. <br /> NOW, THEREFORE, the Owner an.d the Consultant in consideration of their mutual <br /> covenants herein agree in matters pertaining to the performance or furnishing of <br /> professional transportation planning and engineering services by the Consultant with <br /> respect to the Aroject and the payment for those services by the Owner as set forth below. <br /> This Agreement will become effective on the date first above written. <br /> ARTICLE I <br /> CONSULTANT'S RESPONSIBILITIES <br /> The Consultant shall perform for or furnish to the Owner professional planning, <br /> engineering and related services in all phases of the Project to which this Agreement <br /> applies as hereinafter provided. The Consultant shall serve as the Owner's prime <br /> professional. The Consultant may employ subconsultants if Consultant deems it necessary <br /> to assist in the performance or furnishing of professional planning,engineering and related <br /> services hereunder, but only after the approval of the Owner has been obtained. The <br /> Consultant shall not be required to employ any subconsultants which are unacceptable to <br /> the Consultant. <br /> The standard of care for all professional planning, engineering and related services <br /> performed or furnished by the Consultant under this Agreement will be the care and skill <br /> ordinarily used by members oF the Consultant's profession, practicing under similar <br /> conditions at the same time and in the same locality. <br /> 1 <br />
