ARTICLE IV <br /> TIME SCHEDULE <br /> The Consultant agrees to complete the services included in ArEicle II,Scope of Services, <br /> within 4 months following receipt of a notice-to-proceed from the Owner, provided that <br /> all information to be furnished and all reviews to be undertaken by the Owner are <br /> provided and completed without delays. <br /> ARTICLE V <br /> COMPENSATION <br /> The Owner agrees to pay the Consultant as compensation for all services performed for <br /> the Project, the actual cost of performing such work plus 185 percent to cover profit, <br /> overhead,readiness to serve,insurance,social security and retirement deductions - "actual <br /> cost"being defined as direct labor costs. Travel and other out-of-pocket project expenses <br /> will be reimbursed to the Consultant at his documented cost or normal rates. Subject to the <br /> approval of the Owner the Consultant may sublet part of the services idenHfied in Article <br /> II,Scope of Services. If the Consultant subcontracts part of this work, the Owner will pay <br /> the cost of said subcontract to the Consultant plus a five (5) percent service charge. "Cost <br /> to the Consultant" to be verified by Furnishing copies of invoices from the party doing the <br /> work. <br /> Anything in the preceding paragraph not withstanding, in no event shall the Owner <br /> be obligated to the Consultant for any sums in excess of $54,214.00 pursuant to this <br /> agreement,unless expressly agreed to,in writing,by both parties. <br /> Payment for Consudtants' services shall be made in installments billed not more <br /> frequently than once each month upon receipt of invoices from the Consultant,which shall <br /> not exceed the overall percentage complete of the total project. Payment shall be made to <br /> the Consultant by the Owner within thirty (30) days of invoice date. <br /> ARTICLE VI <br /> GENERAL PROVISIONS <br /> l. Times for Rendering Services: The Consultant's services and compensation under this <br /> Agreement have been agreed to in anticipation of orderly and continuous progress of <br /> the Project. Specific periods of time for rendering services are set forth in Article IV, <br /> Time Schedule, in this Agreement, by which times defined services are to be <br /> completed. If such periods of time are changed through no fault of the Consultant, the <br /> rates and amounts of compensation provided for therein shall be subject to equitable <br /> adjustment. The rates used in the development of the fee for this project shall remain <br /> valid until August l, 1995. <br /> 3 <br />
