. . � AG1tEEMENT This Agreement is entered into by and bet��veen the State of Illinois acting through its Department of Transportation, hereinafter referred to as lhe STATE, 1�'Iacon County of the State of Illinois, hereinafter referred to as the COLJNTY, and the City of Decatur of the State of Illinois, hereinafter referred to as the CITY. V�'ITNESSETH WHEIZi�AS, tlie parties hereto, in order to facilitate the free flow of traffic and insure safety to the motoring public, are desirous of construction of a five-lane cross section on C.H. 1 (Brush College Road) from 1�-loutid Road to Brennaman Avenue by cor.stn:ctinD a portland cement concrete pavement 64' face-to-face of curb and gutter; storm sewers; drainage appurtenances; and intersection improvements at Rae's Brici�e Road, Richland Community College Entrance, and Mound Road to include signals at Rae's Bridge Road and Mound Road and construction of a 4 lane cross section on C.H. 1 (Brush College Road) from Illinois Route 48 to Mound Road to include a Portland Cement Conerete Pavement 52' face-to-face of curb and gutter, storm sewer, drainage appurtenance, and intersection improvements at Illinois Route 43 to be identified as COLJNTY Sections 90-00119-01-PV, 90-00 1 1 9-00-02-PV and STAT� Job Number C-95-060-94, both sections hereinafter referred to as the PROJECT, and WHEREAS, the parties hereto aze desirous of said PROJECT in that same will be immediate benefit to the resicients of the area and permanent in nature. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1) It is mutually agreed that the PROJECT will be designed, let and constructed in accordance with Motor Fuel Tax standards, policies and procedures. 2) The COUNTY agrees to make or cause to be made all survey�s; prepare or cause to be prepared the plans, specifications, and estimates; let and award the contract; provide engineering inspection during construction; and cause the improvemeut to be constructed in accordance with the plans,.specifications, and contract "subject to partial reimbursement from the STATE and CITY." 3) Z'he COiJNTY agrees to retain jurisdiction and mainteriance of the completed PROJECT in its entirely. . 4) The COLJNTY agrees to acquire all necessary right-of-way in accordance with Motor Fuel Tax Policy and Procedure prior to adve�tising the PROJ�CT for letting subject to partial reimbursement by the S1�AT� and the CITY. 5) The parties hereto mutually agree that the estimated construction cost of the PROJECT is $6,236,000. The STATE also a�rees to pay the lesser of the amouiits below iii addition to any other funds: a) 50% of tlie cost of the PROJECT, e:ccluding cos!s related to geometric improvements to the intersections of ttic PROJECT, or
