The provisions of this agreement shall supersede the provisions of any ordinance, code <br /> or regulation of the City which may be in conflict with the provisions of this Agreement. <br /> 10. If any provision of this agreement is held invalid, the remainder hereof shall not be <br /> affected thereby. <br /> 11. This agreement shall run with the land, subject to the terms of paragraph 12 and <br /> excluding paragraph 4, and shall be binding upon and accruing to the benefit of McCanes and <br /> Unruh and their successors and assigns; it is further understood that McCanes are the record <br /> owner of the Premises described in Exhibit A, but that Unruh is the contract buyer and that the <br /> real party in interest is Unruh who agrees to be bound hereby and the City agrees that Unruh may <br /> enforce the terms hereof. <br /> 12.
