l`� � y- � t�3 <br /> . AGREEMENT <br /> THIS AGREEMENT made this third day of October, 1994, be- <br /> tween Howard D. Bell , Dorothy L. Bell, Scott H. Bell, and Douglas <br /> V. Bell (hereinafter referred to as "Owner" ) , and the CITY OF <br /> DECATUR, ILLINOIS, a municipal Corporation (hereinafter referred <br /> to as "City" ) , <br /> WITNESSETH: <br /> WHEREAS, they City of Decatur has designated an area of ar- <br /> chitectural and historical significance, in the central business <br /> district, <br /> WHEREAS, Owner is the owner of improved real estate located <br /> within the eligible program area, commonly known as 112 E . <br /> Prairie Street, Decatur, Illinois, and legally described as fol- <br /> lows : <br /> Lot Five (5) of Miller' s Resurvey of Lot Eight (8) , Block Nine <br /> (9) Old Town and Lots Eleven (11) and Twelve (12) in Block One <br /> (1) Central Addition to Decatur, as per Plat recorded in Book 62 <br /> Page 149 the Records of Macon County, Illinois . <br /> Grantor retains the right to use the stairway on the east side of <br /> said Lot Five (5) as an easement for ingress and egress over and <br /> across the second floor of said Lot Five (5) to the second floor <br /> of Lot Six (6) of said Miller' s Resurvey; said easement to be <br /> exercised at reasonable times and upon reasonable notice . <br /> (hereinafter referred to as the "property" ) , and <br /> WHEREAS, City and Owner desire to restore, maintain and <br /> preserve the exterior design and facade of the building situated <br /> on the property and open areas in the eligible area, and the City <br /> has agreed to provide funds for certain restoration work as set <br /> forth in this Agreement, using funds made available to City by <br /> the Community Development Block Grant program of the United <br /> States Department of Housing and urban Development, and <br />
