Contractor shall provide worker's compensation insurance covering all employees of Contractor engaged in the performance of this agreement, in accordance with the Illinois Workers Compensation Law. Proof of such insurance will be provided by Contractor on request of the City. SECTION XIII DEFAULT; REMEDIES; TERMINATION 13.1. Failure by Contractor to perform any obligation or duty of Contractor under this agreement or to comply with any provision of this agreement to be complied with by Contractor shall be a default under this agreement. If any default is not cured or remedied by Contractor within ten days after written notice of the default is given to the Contractor the City may exercise any one or more of the remedies available to it provided by this agreement or at law or in equity or by statute; provided, however, that if Contractor commences curing or remedying a default within the ten day period but is unable to cure the default within the ten day period then the period for cure of default shall be extended for the period of time reasonably necessary to cure the default. 13.2. In the event of a default herein by Contractor which is not cured or removed within the ten da.y period or extension thereof, the City shall have the right to: (a) Terminate this agreement by written notice to the Contractor, which termination shall be effective on the date specified in such notice. (b) Suspend payment of all monies due or to become due to Contractor under this agreement, provided, however, that said suspension of monies shall be subject to the curing of the default only and shall not be treated as liquidated damages hereunder in the event a default is timely cured, otherwise suspended funds may be treated as liquidated damages pursuant to Subsection 13.3 hereof;
