CONTRACT THIS AGREEMENT, made and concluded this 15 th day of August , 1994, between the City of Decatur, Illinois, acting by and through its Council, hereinafter called "Owner", and Mid-States General & Mechanical Contracting Cor�, its/their executors, administrators, successors or assigns, hereinafter called "Contractor." WIT`NESSETH: That for and in consideration of the payments and agreements mentioned in the proposal for the improvement officially known as City Project GC-8715 - Construction of a Mass Transit FacilitX hereto attached, to be made and performed by the Owner, and according to the terms expressed in the bond referring to this agreement, the Contractor agrees with the Owner at its/their own proper cost and expense to do all the work, furnish all materials and labor necessary to complete the work in accordance with the plans and specifications hereinafter described, and in full compliance with all of the terms of this agreement and the requirements of the Engineer under it. And it is also understood and agreed that the Notice to Contractors, Proposal, Standard Specifications, Supplemental Specifications, Special Provisions, Contract Bond and Plans hereto attached are all essential documents of this Contract and are a part thereof. And it is further understood that this project is being carried out in two phases. The original contract, for $1,363,910, authorized by the Council on May 16, 1994, was for the work identified on the attachment for Phase I. This contract for $603,090 is for the construction activities identified on the attachment as Phase II. The total amount awarded for GC-8715- Construction of a Mass Transit Facility is $1,967,000.
