APPENDIX D <br /> OWNERSHIP OF DOCUMENTS <br /> All documents, data and records produced by the PLANNING AGENCY in <br /> carrying out PLANNING AGENCY' s obligations and services hereunder, <br /> without limitation and whether preliminary or final , shall become and <br /> remain the property of the DEPARTMENT. <br /> (a) The DEPARTMENT shall have the right to use all such documents, <br /> data and records without restriction or limitation and without <br /> restriction or limitation and without compensation to PLANNING <br /> AGENCY and PLANNING AGENCY shall have no right or interest <br /> therein. <br /> (b) All documents, data and records utilized in performing the <br /> research shall be available for examination by the DEPARTMENT <br /> upon request. <br /> (c) Upon completion of the services hereunder or at the <br /> termination of this AGREEMENT, all such documents, data and <br /> records shall , at the option of the DEPARTMENT, be <br /> appropriately arranged, indexed and delivered to the <br /> DEPARTMENT by PLANNING AGENCY. <br /> (d) Any documents, data and records given to or prepared by the <br /> PLANNING AGENCY under this AGREEMENT shall not be made <br /> available to any individual or organization by the PLANNING <br /> AGENCY without prior written approval of the DEPARTMENT. Any <br /> information secured by PLANNING AGENCY from the DEPARTMENT in <br /> connection with carrying out the services under this AGREEMENT <br /> shall be kept confidential unless disclosure of such <br /> information is approved in writing by the DEPARTMENT. <br /> -12- <br />
