Gade,Director 2200 Churchill Road, Springfield,IL 62794-9276 <br /> AMENDED AGREEMENT TO DELEGATE AUTHORITY <br /> TO ISSUE PERMITS FOR WATER MAIN EXTENSION <br /> In 1980, the General Assembly amended the Environmental Protection Act to allow the <br /> Illinois Environmental Protection Agency (Agency) to enter into agreements to <br /> delegate to units of local government authority to issue construction and operating <br /> permits for sewer and water main extensions. In response to this amendment, the <br /> Agency promulgated rules for delegation (35 I11. Adm. Code 174) . <br /> On February 4, 1991 the City of Decatur (City) submitted an application to be <br /> dele <br /> gated permit authorit for water main extensions. Th <br /> Y e Agency and the City <br /> subseque:�tly entered into a per,<<it delegatior. a�reement. By l�tter, date-d :�Iay 13, <br /> 1994, the City requested that the Agreement be amended. The Agency has reviewed this <br /> request and found it to be proper. <br /> Therefore, pursuant to I11. Rev. Stat. 1981, ch. 111 1/2, par. 1004(g) and 35 I11. <br /> Adm. Code 174, the Agency and the City enter into the following agreement. The <br /> Agency will delegate its authority to issue construction and operating permits for <br /> water main extensions of the City's distribution system in return for the City's <br /> agreement to administer the permit program according to the following conditions: <br /> 1. Michael E. Kazunas, P.E. , 062-049040, shall be in responsible charge of the <br /> review and preparation of plan documents. <br /> 2. Bruce A. McNabb, P.E. , 062-048695, shall be in responsible charge of issuing <br /> construction or operating permits. No permit shall be valid unless it is <br /> signed by Mr. McNabb. Mr. McNabb shall not participate in the review or <br /> preparation of plan documents. <br /> 3. The water main specifications by which plans shall be reviewed are the American <br /> Water Works Association Standards for materials and the "City of Decatur, <br /> Illinois Standard Specifications for Water Main Construction" Revised October, <br /> 1989. <br /> 4. Documents, plans, analyses and permits shall be correlated by assigning a City <br /> Engineering Division filing system number (which is a sequential number <br /> followed by the City's current fiscal year) at the time of project initiation <br /> and carried with the project to completion. <br /> 5. The City shall perform the following routine operations: <br /> a. Water samples shall be collected from the completed main in accordance <br /> with Technical Policy Statement 652.203 (35 I11. Adm. Code 652.203) . <br /> b. If there are changes in construction from the preliminary plans described <br /> in annual reports, the Agency shall be notified of those changes within <br /> 10 days after construction has begun. <br /> c. If the construction shown in the as-built plans filed in the annual report <br /> does not conform to the approved specifications or 35 I11. Adm. Code <br /> Subtitle F, Chapter I and II, corrections shall be made consistent with <br /> those regulations. <br /> Printed on Recrcled Paper <br />
