� r . <br /> b. Interest of Members of or Delegates to Cong;ress. No member of or delegate to the Congress <br /> - of the United States shall be admitted to any share or part of this Project or to an}� benefit <br /> therefrom. <br /> c. Bonus or Commission. The Recipient ��•anants that it has not paid, and agrees not to pay, any <br /> bonus or commission for the purpose of obtaining approval of its application for financial <br /> assistance for this Project. <br /> d. Prohibition Aeainst the Use of Federal Funds for Lobb��in�. 'I'he Recipient agrees to comply <br /> ���ith the pro��isions of 31 U.S.C. § 1352, "�hich prohibit the use of Federal funds for lobbying <br /> any of�cial or employee of any Federal agency, or member or employee of Congress; and <br /> requires the Recipient to disclose any ]obbying of any official or employee of any Federal <br /> agency, or member or employee of Congress in connection ���ith Federal assistance. The <br /> Recipient agrees to comply "�ith U.S. DOT regulations, "�Te"• Restrictions on Lobbying," 49 <br /> C.F.R. Part 20. <br /> e. Emplo��ee Political Acti��itv. The terms of the "Hatch Act," 5 U.S.C. �§ 1501 through 1508, <br /> and Office of Personnel Mana�ement regulations, "Political Acti��ity of State or Local Officers <br /> or Emplo��ees," 5 C.F.R. Part l 5], apply to State and local agencies and their officers and <br /> emplo}�ees to the extent co��ered by the statute and regulations. The "Hatch Act" restricts the <br /> political acti��ity of an indi��idual principally employed by a State or loeal executive agency in <br /> connection «�ith a program financed in ���hole or in part by a Federal loan, grant, or cooperati�e <br /> agreement. Ho���e��er, the "Hatch Act" does not apply to a nonsuper�•isory employee of a transit <br /> s��stem (or of any other agency or entity performing related functions) receiving FTA assistance <br /> to ���hom the "Hatch Act" is other��•ise inapplicable. <br /> f. False or Fraudulent Statements or Claims. The Recipient ackno�vledges that if it makes a <br /> false, fictitious, or fraudulent claim, statement, submission, or certification to the Government in <br /> connection ���ith this Project, the Go��ernment reser��es the right to impose on the Recipient the <br /> penalties of 18 U.S.C. � 1001, 3] U.S.C. �� 3801 et se�c., and 49 U.S.C. app. § 1607a(h), as the <br /> Go��ernment may deem appropriate. The terms of U.S. DO? regulations, "Program Fraud Ci��il <br /> Remedies," 49 C.F.R. Part 3l, apply to this Project. <br /> Section 104. Proiect Bud�et. <br /> The Recipient agrees to prepare and maintain a Project Budget. T'he Recipient agrees to incur <br /> obligations a�ainst and make disbursements of Project funds only as authorized in the latest <br /> Approved Project Budget. The Approved Project Budget may be revised to the extent permitted <br /> by and in conformance ���ith appiicable Government requirements. <br /> Section 105. Accountine Records. <br /> a. Project Accounts. T'he Recipient agrees to establish and maintain for the Project either a <br /> separate set of accounts or accounts ���ithin the frame"�ork of an established accounting system, <br /> Page 5 <br />
