Rte. 7439 <br /> Section District 5 Pedestrian <br /> Ramps 1995-1 <br /> Macon County <br /> Contract No. 90640 <br /> C-95-017-94 <br /> Agreement No. JN-594006 <br /> City of Decatur <br /> AGREEMENT <br /> This agreement, entered into this �i rG( day of ��cy� , <br /> A.D. 19�, by and between the STATE OF ILLINOIS, acting by and through its <br /> DEPARTMENT OF TRANSPORTATION hereinafter called the STATE, and the City of <br /> Decatur, of the State of Illinois, hereinafter called the CITY. <br /> WITNESSETH: <br /> WHEREAS, The STATE in order to comply with the Americans With <br /> Disabilities Act of 1990 and insure safety to the public, is desirous of <br /> constructing curb ramps to provide accessibility for individuals with <br /> disabilities, along North Main Street (F.A.P. Rte. 710/U.S. Bus. 51) from <br /> Damon Avenue to Decatur Street; Water Street (F.A.P. Rte. 710 Alt . /U.S. <br /> Bus. 51) from Ash Avenue to King Street; Oakland and Fairview Streets <br /> (F.A.U. Rte. 7439/IL. Rte. 48) at Marietta and Center Streets; Eldorado <br /> Street (F.A.P. Rte. 741/IL. Rte. 105) from 24th Street to 26th Street; <br /> South Franklin Street (F.A.P. Rte. 710 Alt . /U.S. Bus. 51) from Wood Street <br /> to Marion Street; and by performing all other work necessary to complete <br /> the improvement in accordance with the approved plans and specifications; <br /> and <br /> WHEREAS, the CITY in order to comply with the Americans with <br /> Disabilities Act of 1990 is desirous of said improvement in that same will <br /> be of immediate benefit .to the CITY residents and permanent in nature. <br /> NOW, THEREFORE, in consideration of the mutual covenants contained <br /> herein, the parties hereto agree as follows : <br /> l . The STATE agrees to make the surveys, obtain all necessary rights ' <br /> of way, prepare plans and specifications, receive bids and award �, <br /> the contract, furnish engineering inspection during construction I <br /> and cause the improvement to be built in accordance with the ,, <br /> plans, specifications and contract . <br /> 2 . The STATE agrees to pay all rights-of-way, construction and <br /> engineering costs, subject to reimbursement by the CITY as <br /> hereinafter stipulated. <br /> 3 . It is mutually agreed by and between the parties hereto that the <br /> estimated cost and cost proration for this improvement is as <br /> follows : <br />
