. <br /> ANNEXATION AGREEMENT <br /> This Annexation Agreement made by and between the City og <br /> Decatur, Illinois, a municipal corporation, ("City") , Pheasant <br /> Run, Inc. , an Illinois Limited Liability Corporation ("Pheasant <br /> Run" ) , and Don Westerman , Inc. , a Delaware Corporation, <br /> ("Westerman") . <br /> WHEREAS, Westerman is the owner of the following describecl <br /> premises: <br /> The West 660 feet of the West Half (W 1/2) of the <br /> Southeast Quarter (SE 1/4) of Section 26, Township 17 <br /> North, Range Two East of the Third Principal Meridian <br /> lying North of the tract described in the document <br /> recorded in Book 1481 Page 425 (Stevenson School) of the <br /> records in the Recorder' s Office of Macon County, <br /> Illinois, <br /> ("Premises") , <br /> which Premises are located outside of the corporate limits of the <br /> City and are contiguous thereto; and, <br /> WHEREAS, Westerman desires to annex said Premises to the <br /> City, but only upon certain terms and conditions; and, <br /> WHEREAS, the City agrees that the terms and conditions, as <br /> contained herein, are reasonable and acceptable; and, <br /> WHEREAS, hearings have been held and notice given as <br /> required by law. <br /> NOW, THEREFORE, for and in consideration of the mutual <br /> promises and obligations made and assumed herein, and pursuant to <br /> the authority of 65 ILCS 5/11-15. 1-1 et seq. , the City, Pheasant <br /> Run and Westerman agree as follows: <br /> 1. Pheasant Run and Westerman shall file an annexation <br /> petition with the City, in compliance with 65 ILCS 5/7-1-8, said <br />
