�, ' ' ' ' � INTERGOVERNMENTAL COOPERATION AGREEMENT Between the Sanitary District of Decatur ' a Municipal Corporation, and the City of Decatur, Illinois, a Municipal Corporation, both of Macon County, Illinois ' for the construction of the West Mound Road Trunk Sewer Extension THIS AGREEMENT made this�day of , 1994,is between the � Sanitary District of Decatur,Illinois,a Municipal Coiporation,Macon County,Illinois("DISTR.ICT")and , the City of Decatur,Illinois,a Municipal Coiporatian,Macon County,Illinois("CI'TY"). WHEREAS,pursuant to Article VII,section 10 of the 1970 Constitution of the State of Illinois, � and the Illinois Intergovemmental Cooperation Act(SILCS 220/1 et seq- 1992),units of local govemment � in the State of Illinois may contract between themselves to obtain or share services and to exercise or combine functions which either of the units of local goveminent are authorized by law to perfonn;and, , WHEREAS,the CITY agrees that the construction,operation and maintenance of the West Mound Road Trunk Sewer Extension is the responsibility of the CTI'Y, � WHEREAS,the CIT'Y requests the DISTRICT construct the West Mound Road Trunk Sewer � Extension, WHEREAS,the CITY requests the DISTRICT operate and maintain the West Mound Road Trunk � Sewer Extension, WHEREAS,the CTTY and DISTRICT mutually agree that the above named sewer should be ' included in the DISTRICTS construction pro�ram;and � NOW,THEREFORE,in consideration of the mutual covenant herein contained,the parties agree as follows: ' 1.)
