' ' � • � Intergovemmental Cooperation Agreement West Mound Road Tnuik Sewer E�ctension � , 10) INDEMNIFICATION For and in consideration of the mutual covenants contained herein,the CITY ' forever agrees to save hannless and indemnify the DISTRICT,its administrators,servants or employees,directors,trustees,contractors and/or subcontractors,agents and assigned, from � any and all claims which may hereafter be presented by anyone for loss,damage,and property or � personal injury as a result of the DISTRICTs obligations under this agreement,excluding the DISTRICTs own negligence. The C1TY agrees to be responsible for the cost of any settlements, , judgments or verdicts resulting from any and all claims against the DISTRICT due to the DISTRICTs obligation herein. The CITY also agrees to be responsible for defending the ' DISTRICT against any and all claims and the cost associated with the defense,including,but not ' limited to attomeys fees. 11) INSURANCE ' The City agrees to procure and maintain,at its expense during the life of this Agreement, insurance of the types and in the minunum amounts stated below: � (a) Worker's Compensation Instuance in full compliance with the worker's ' compensation and employets liability coverage in the amount as defined by the Illinois State Statutes with the following liability limits: $250,004.00 each accident,bodily injury by accident, 1 $250,000.00 each employee,bodily injury by disease,$540,000.00 policy limit,bodily injury by disease. � (b) Commercial General Liability including explosion,collapse and underground � property damage liability and blanket contractual liability coveiing the liability assumed by the CITY under this agreement with the limits of not less than: $1,000,400.00 general aggregate limit, ' other than products-completed operation,$1,OOO,Q00.00 products-completed operations , f 5
