f �.; . , . . _ � .a . 9 � - �� .. � AMENDMENT N0. 4 TO AN AGREEMENT BETWEEN THE STATE OF ILLINOIS DEPARTMENT OF TRANSPORTATION AND THE CITY OF DECATUR (Contract No. 1353) PROJECT CAP-87-303-FED This Amendment No. 4 to an Agreement dated April 16, 1987 between the State of Illinois, Department of Transportation and the City of Decatur is made and entered into by and between the parties thereto. In consideration of the mutual covenants contained herein and in such Agreement the Parties agree as follows: 1. To amend Part I - "MASS TRANSPORTATION CAPITAL GRANT AGREEMENT" by deleting ITEM 2 and replacing it with the following ITEM 2 - AMOUNT OF GRANT The Department agrees to make a Grant in an amount equal to $498,657 or 20 percent of the total project cost, whichever is less. The total state share shall be determined by the Department after completion of the Pro�ect. The Department at its sole discretion may agree to increase the amount of the grant in excess of the amount specified herein in the event that the amount of the federal grant made in connection with this project is subsequently increased, but in no event shall the total amount provided by the Department under this Agreement or any subsequent Amendment to this Agreement exceed 20 percent of the total pro�ect cost. No liability sha11 be incurred by the State in excess of the amount of the Grant. 2. To amend Part I- "MASS TRANSPORTATION CAPITAL GRANT AGREEMENT" by deleting ITEM 1 and replacing it with the following: ITEM I - "THE PROJECT" The grantee agrees to undertake and complete the Project and to provide for the use of Project facilities and equipment as described in the grantee's final application approved by the Department, as specified by the approved Pro�ect Budget and in accordance with this Agreement and all applicable laws.
