<br /> 4. That all reports, pians, plats, estimates,and special conditions to be furnished by the
<br /> ENGINEER in accordance with ia to 1n, inclusive,of THE ENGINEER AGREES shall be in
<br /> accordance with the current standard specifications and policies of the CITY, it being
<br /> understood that all such reports, plans, estimates,and drafts shall, before being finally
<br /> accepted, be subject to approval by the CITY. . During the performance of the engineering
<br /> services herein provided for, the ENGINEER shall be responsible for any loss or damage to
<br /> the documents herein enumerated while they are in the ENGINEER's possession and any
<br /> such loss or damage shall be restored at the ENGINEER's expense.
<br /> 5. To attend conferences to be held at the request of the CITY and visit the site of the work at
<br /> any reasonable time when requested to do so by the CITY.
<br /> . 6. That tracings, plans, specifications,estimates,maps and other documents prepared by the
<br /> ENGINEER in accordance with the AGREEMENT shall be delivered to and become the
<br /> property of th� CITY and that basic survey notes, sketches, charts, and other data prepared
<br /> or obtained in accordance with this AGREEMENT shall be made available, upon request,to
<br /> the CITY, without restriction or limitation as to their use. The CITY agrees to waive any
<br /> claims against the ENGINEER and defend, indemnify and hold harmless from any claim or
<br /> � liabilities for injury or loss if the documents are used for other than this project without the
<br /> written permission of the ENGWEER.
<br /> 7. That should the CITY require changes in any of the detailed construction plans, specifications,
<br /> or estimates after they have been completed in accordance with the contract or as a result of
<br /> policy changes by the CITY during the time work is undervvay, the CITY shall pay the
<br /> ENGINEER for such extra work in accordance with Section 3 of THE CITY AGREES. It is
<br /> understood that "changes"as used in this section means basic changes in location or design
<br /> and that the provisions of this section shall in no way relieve the ENGINEER of his
<br /> responsibility to prepare a complete and adequate set of plans satisfactory to the CITY.
<br /> 8. That he will save harmless the CITY, any other governmental agency, or any representative of
<br /> the CITY or any other governmental agency from all claims and liabilities due to negligent
<br /> � activities of himself, his subcontractors, his agents or his employees and that he will carry
<br /> insurance to provide such protection. .
<br /> 9. That he will comply with applicable Federal Statutes, State of Illinois Statutes, and local laws
<br /> or ordinances of the CITY. ;
<br /> 10., That none of the services to be furnished by the ENGINEER shall be sublet, assigned,or I
<br /> transferred to any other party or parties without the written consent of the CITY, except for
<br /> KM2 Design Group, P.C. Springfield,Illinois,who will furnish professional services for a
<br /> minimum 7.6 percent of this contract to fulfill the CITY DBE requirement. The consent to
<br /> sublet, assign or othervvise transfer any portions of the services to be furnished by the
<br /> ENGINEER shall not be construed to relieve the ENGINEER of any responsibility for the
<br /> � fulfillment of this AGREEMENT.
<br /> 11. That all plans, specifications,estimates,plats and other documents fumished to the CITY by
<br /> the ENGINEER in accordance with this AGREEMENT shall be endorsed by him and shall
<br /> show his professional seal where such is required by law. � -
