THE CITY AGREES, <br /> l . To furnish the ENGINEER with all presently available survey <br /> data and information, including Standard Specifications <br /> adopted by the CITY and other available data useful to the <br /> work to be done by the ENGINEER. <br /> 2 . To pay the ENGINEER as compensation for all services <br /> rendered in accordance with Section 1 under THE ENGINEER <br /> AGREES of this AGREEMENT) , a lump sum fee of Thirt.y-seven <br /> thousand, seven hundred seventY and no/100 Dollars- <br /> ( $37 , 770 . 00 ) as payment in full for the work specified <br /> above. <br /> 3 . To pay the ENGINEER for services rendered in accordance with <br /> Section 7 (Changes ) ; and/or Section 16 (Termination) under <br /> THE ENGINEER AGREES of the AGREEMENT, the technical payroll <br /> cost of performing such work times a multiplier of 2 . 04 to <br /> cover overhead, profit , and readiness to serve . Direct <br /> expenses , for items such as aerial surveys , telephone tolls , <br /> stakes , iron pins , monuments , flagging , blue prints , and <br /> electronic computer shall be reimbursed at actual cost. ' <br /> "Technical payroll cost" is defined as salary cost plus (but <br /> not limited to ) insurance , social security, vacation <br /> allowance , and retirement costs . <br /> 4 . That payment to the ENGINEER for services rendered in ' <br /> accordance with Section 2 of THE CITY AGREES of this ' <br /> AGREEMENT will be made monthly by partial payments based ' <br /> upon percentage of total work accomplished. ' <br /> 5 . That payment to the ENGINEER for services rendered in ' <br /> accordance with Section 3 of THE CITY AGREES will be made ' <br /> monthly by partial payments based upon costs to the ' <br /> ENGINEER. ' <br /> IT IS MUTUALLY AGREED, ' <br /> 1 . Disputes - That any differences between the ENGINEER and the � <br /> CITY concerning the interpretation of the provisions of this ', <br /> AGREEMENT shall be referred to a committee of disinterested ' <br /> parties consisting of one member appointed by the ENGINEER, ' <br /> one member appointed by the CITY, and a third member ap- ' <br /> pointed by the two above noted members , for disposition and <br /> that the committee ' s decision shall be final . ' <br /> 2 . Completion - That all report services as stated in Paragraph ' <br /> 1 of "THE ENGINEER �R�ES" are to be completed under this ' <br /> AGREEMENT within �� � after the CITY issues a written ' <br /> Notice to Proceed .
