R 3 --fl3 RESOLUTION RECEIVING REQUEST FOR SITING APPROVAL OF REGIONAL POLLUTION CONTROL FACILITY AND SETTING HEARING THEREON WHEREAS, on October 21, 1992 , Morgan Distributing Inc. did file with the City Clerk of the City of Decatur, Illinois, a request for local siting approval of a regional pollution control facility pursuant to the provision of the Illinois Environmental Protection Act (415 ILCS 5/1 et seq. ) , a copy of which request is submitted herewith; and, WHEREAS, the aforementioned Act requires that a public hearing be held upon such request no sooner than 90 days but no I later than 120 days from the date of filing of such request; and, '�, WHEREAS, said Act further requires that notice of such public hearing be published once each week for three (3) successive weeks in a newspaper of general circulation in Macon County, and that notice of same also be sent by certified mail to all members of the General Assembly from the district in which the proposed site is located, to the governing authority of every municipality contiguous to the proposed site or contiguous to the municipality in which the proposed site is to be located, and to the Illinois Environmental Protection Agency. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1. That the request of Morgan Distributing Inc. for local siting approval of a regional pollution control facility for the premises commonly known as 3425 North 22nd Street, as described in said application submitted herewith, be, and the same is hereby, received, and the filing of same on October 21, 1992 is hereby acknowledged. Section 2. That a public hearing upon said request be, and the same is hereby, scheduled for Friday, February 5, 1993 at 1: 30 P.M. in the Council CHamber located at #1 Civic Center Plaza, Decatur, Illinois, and the City Clerk be, and she is hereby, authorized and directed to give notice of said hearing as required by law. Section 3 . That �David A. Clark, Director of Community Development, be, and he is hereby, appointed as hearing officer for said hearing, and said officer is hereby further authorized to adopt such rules of procedure for said hearing as are in conformance with said Act and will assist in accomplishing the objectives thereof.
