Box 45052
Jacksonville, FL 32232-5052
Dear Mr. Kelly:
This is to advise you of the enactment of new legislation
affecting all state Agreements/Contracts. Public Act 87-991 ,
which became effective on September 1 , 1992, requires the
retention of job records for a period of five years following job
completion.
The following paragraph will be attached to all Agreements
currently in process with execution dates after September 1 , 1992,
and will be included in the text of all future Agreements:
The COMPANY shall maintain, for a minimum of 5 years after
the completion of the contract, adequate books, records, and
supporting documents to verify the amounts, reciients, and
uses of all disbursements of funds passing in conjunction
with the contract; the contract and all books, records, and
supporting documents related to the contract shall be
available for review and audit by the AUDITOR GENERAL; and
the COMPANY agrees to cooperate fully with any audit
conducted by the AUDITOR GENERAL and to provide full access
to all relevant materials. Failure to maintain the books,
records, and supporting documents required by this section
shall establish a presumption in favor of the STATE for the
recovery of any funds paid by the STATE under the contract
for which adequate books, records, and supporting
documentation are not available to support their purported
di sbu rsement.
In order to simplify the handling of Agreements currently in
process, the above cited paragraph will be attached to these
Agreements with reference to this letter when said Agreements are
returned to this office for execution by the state.
