Anderson <br /> Decatur, IL 62523-1196 <br /> Re: Stifel, Nicolaus & Company, Inc. <br /> Satellite Dish Space <br /> Dear Mr. Weaver: <br /> By this Letter Agreement on behalf of Stifel, Nicolaus & Company, Inc., we request your <br /> authorization for Satellite Dish Space to be installed at their current location. <br /> 1. Satellite Dish Space. In conjunction with the use of Tenant's space <br /> allowed in the Lease, provided the Tenant is not in default under the <br /> Lease, Landlord will allow to be constructed by Tenant's contractor, <br /> if approved by Landlord, in accordance with plans and specifications <br /> as prepared by the Tenant at Tenant's expense and subject to the <br /> written approval of the Landlord, which approval shall not be <br /> unreasonably withheld or delayed, a Satellite Dish Station either on the <br /> roof with a non-penetrating base, a mast attached to the side of the <br /> building, or a pole set in the ground ("the Satellite Dish"), at a location <br /> reasonably designated by the Landlord,provided that the Satellite Dish <br /> shall be located at a location which will allow or permit the Satellite <br /> I'iish iu :�e effCciively opzrat�i, ihe Landiurci hCreby acl:nuwlr,ciging <br /> that the location of the Satellite Dish is important and critical to the <br /> operation of the Satellite Dish. Tenant shall be required to design, <br /> operate and maintain the Satellite Dish as appropriate. Tenant shall be <br /> obligated to all terms and conditions as set forth in the Lease as <br /> modified in this Paragraph 1. Landiord shall have no obligation to the <br /> Tenant whatsoever with regard to the Satellite Dish or its Space except <br /> to make available for the Tenant's use this space (on the roof of the <br /> Building or other suitable location) in an "As Is" condition. It is <br /> further understood that the use and operation of the Satellite Dish shall <br /> be at Tenant's sole expense, and that it shall be installed, maintained, <br /> operated and removed all in complete compliance with all government <br /> regulations and codes now in effect as well as any amendments thereto. <br /> The Satellite Dish Space will be used solely for the purpose of <br /> operating a communications station solely for Tenant's private use. <br />
