If Magna, or its successors or assigns, <br /> subdivides the Premises, or any part thereof, at any <br /> time during the term of this Agreement, the City shall <br /> not, as a condition thereof, require any contribution, <br /> of either land or money, or the payment of any impact <br /> fees, regardless of whether such contributions or fees <br /> are otherwise applicable by operation of any ordinance <br /> or ordinances passed and adopted subsequent hereto. <br /> 11.
