(the "Zoning Ordinance") and as is in effect as of the <br /> date of this Agreement. <br /> l0. If Magna, or its successors or assigns, <br /> subdivides the Premises, or any part thereof, at any <br /> time during the term of this Agreement, the City shall <br /> not, as a condition thereof, require any contribution, <br /> of either land or money, or the payment of any impact <br /> fees, regardless of whether such contributions or fees <br /> are otherwise applicable by operation of any ordinance <br /> or ordinances passed and adopted subsequent hereto. <br /> 11. Improvements to Hickory Point Road adjacent <br /> to the Premises, if any, shall be made without <br /> liability for the payment thereof, in whole or part, by <br /> Magna or its successors or assigns, whether by special <br /> assessment or otherwise; provided that, Magna, or its <br /> successors or assigns, shall dedicate to the City <br /> sufficient right-of-way to accomodate such improvement, <br /> as determined by the Director of Public Works of the <br /> City, but not to include any portion of the Premises <br /> located at a distance greater thah forty (40) feet from <br /> the centerline of Hickory Point Road. <br /> 12.
