fact that said sites have not been subdivided as per the <br /> Subdivision Ordinance; provided that, no certificate of <br /> occupancy shall be issued for any building so constructed <br /> until such sites have been subdivided as provided by law. <br /> 11 . B & R shall not be required to furnish sidewalks <br /> on Hickory Point Road, Oakland Avenue, or within the <br /> boundaries of the Premises, the Subdivision Ordinance to the <br /> contrary notwithstanding. <br /> 12 . During the term of this agreement, neither B & R <br /> nor its successors or assigns shall petition any city or <br /> village other than the City of Decatur for annextion <br /> thereto, nor shall B & R, and its successors and assigns, <br /> agree to or cooperate in any way with such annexation, <br /> except as provided herein. <br /> 13 . The provisions of this agreement shall supersede <br /> the provisions of any ordinance, code or regulation of the <br /> City which may be in conflict with the provisions of this <br /> Agreement. <br /> 14 . If any provision of this agreement is held <br /> invalid, the remainder hereof shall not be affected thereby. <br /> 15. This agreement shall run with the land, subject to <br /> the terms of paragraph 16, and excluding paragraph 6, and <br /> shall be binding on B & R and its successors and assigns; <br /> provided that, the liability described in paragraph 9 <br /> hereof shall be solely that of B & R, and none other. <br />
