RESOLUTION NO. R �� — 3 � RESOLUTION AUTHORIZING WRITTEN NOTICE FOR REMOVAL OF STREAM OBSTRUCTIONS WHEREAS, I11.Rev.Stat. 1989, ch. 24 , par. 11-111 . 1-1 authorizes municipalities to enter upon the lands or waters of any person and remove obstructions from natural or other watercourses located thereon, but only if such obstructions are causing flooding within the corporate limits of said municipality, and only upon ten (10) days written notice to the owner or owners of said lands or waters; and, WHEREAS, there are such obstructions as described herein located on the following described premises: All of the SW 1/4 of the NE 1/4 Section 27 , Township 17 North, Range 2 East of the 3rd P.M. , EXCEPT Shadow Lane First, Second, Third, Fourth and Sixth Additions and ALSO EXCEPT Windsor Village 7th Addition; and, WHEREAS, said obstructions located on the property aforesaid should be removed. NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section 1 . That the Director of Public Works be, and he is hereby, authorized and directed to serve, or cause to be served, written notice on the owner or owners of said property, said notice to state that if said obstructions are not removed within ten (10) days of the date thereof the City, through its agents or employees, will enter upon said property and remove said obstructions. Section 2 . That if, after ten (10) days from the date of said notice, said obstructions have not been removed, the Director of Public Works be, and he is hereby, authorized and directed to cause agents or employees of the City to enter upon said property and remove said obstructions.
