One medium <br /> shall provide a listing of the Participants and one <br /> shall provide the amount of contributions to each <br /> Participants' account. The media shall be delivered to <br /> FDL within 4 working days of each payroll period. <br /> 3) Such information as to benefits as will enable FDL to <br /> prepare accurately any cost estimates or reports <br /> required in Appendix A or to assist in the preparation <br /> of any materials for distribution to members. <br /> B. The Plan Sponsor shall have the sole responsibility for and <br /> shall bear the entire cost of compliance with all federal, <br /> state and local rules and laws including, but not limited to, <br /> any licensing, filing, reporting and disclosure requirements <br /> as may apply to the Plan, and all costs, expenses and fees <br /> relating thereto. <br /> C. The Plan Sponsor agrees to indemnify and hold harmless FDL <br /> and its affiliates and their directors, officers and <br /> employees against any and all loss, liability, damages, <br /> penalties and expenses, including attorney's fees, or other <br /> cost or obligation resulting from or arising out of claims, <br /> lawsuits, demands, settlements or judgements brought against <br /> FDL in connection with a claim for benefits under the Plan <br /> unless it is determined that the liability therefore was the <br /> direct consequence of dishonest or criminal conduct, bad � <br /> 4 !� <br />
