LEGAL DEPARTMENT MEMORANDUM <br /> No. 91-46 <br /> December 11 , 1991 <br /> TO: Honorable Mayor and City Council Members <br /> FROM: John W. Couter, Corporation Counsel <br /> RE: Lost Road Vacation <br /> Submitted herewith for Council approval is an agreement <br /> with the Town of Oakley Road District for the vacation of a <br /> portion of Lost Road. This road is located amidst those <br /> properties recently purchased by the City for the deposit of <br /> sediment from the Faries Park Basin dredging project, and <br /> will be needed as part of the sediment disposal site. The <br /> agreement provides that the City will pay to the Road <br /> District $7 , 500, as well as reimburse the District for the <br /> costs of this vacation. (Costs are estimated to be <br /> approximately $2 , 000 . ) In addition, the City will repair <br /> any damages to District roads caused by the dredging project <br /> and hold the District harmless for damages to the City <br /> caused by the vacation. Upon vacation, the City will be the <br /> owner of the subject portion of Lost Road. <br /> Such vacation is necessary for the completion of the <br /> sediment disposal site, and Council approval is <br /> recommended. <br /> JWC:pm <br />
