<br /> (9) An abstract or Title Policy from the United States Government to date, �showing a merchantable title, shall be
<br /> furnished within a reasonable time and if the title, upon examination, is found materially defective, within ten days after said
<br /> Abstract or Title Policy is furnished, then;�unless the material defects be cured within sixty days after written notice thereof, the
<br /> said earnest money shall be refunded and this contract shall become inoperative.
<br /> (]O) In case the improvements on the atoresaii premises should be injured by fire or otherwise before the delivery of the '
<br /> deed as herein provided, the purchaser shall have the option to declare this contract null and void, or demand that the premises
<br /> be restored to the original condition, as of the date of the execution of this contract and if contract is declared null and void the
<br /> earnest money paid hereon shall be refunded to the purchaser.
<br /> (11) Should said purchaser fail to perform his contract promptly on his part at the time and in the manner herein
<br /> specified, the earnest money paid as above shall, at the oplion of the seller, be retained as liquidated damages, including
<br /> commissions payable by seller, and this contract shall become null and void; or the seller may elect to continue this contract in
<br /> full force and effect and hold [he purchaser for all damages arising from a breach of the provisions hereof. The terms of this
