. � <br /> �r <br /> SANITARY SEWER SERVICE AGREEMENT <br /> For and in consideration of the undertakings and covenants <br /> set out herein, it is agreed by and between CLARENCE SMETHERS <br /> ("Owner") , and THE CITY OF DECATUR, ILLINOIS, ( "City") , as <br /> follows: <br /> l . The provisions of this Aqreement, and the installation, <br /> operation and use of the sanitary sewer service authorized <br /> hereby, are expressly made subject to all applicable provisions <br /> of codes, ordinances, rules and regulations of City, and Owner <br /> agrees to comply therewith. <br /> 2 . Upon obtaining a tapping permit in the customary manner <br /> followed by the City for premises within its corporate limits, <br /> Owner may tap the sanitary sewer of City existing in North Court <br /> Drive and connect a sanitary sewer service thereto to furnish <br /> residential service only to the premises of Owner, commonly known <br /> as 30 North Court Drive, Decatur, Illinois, and described as: <br /> Lot Six (6) of Highland Court as per Plat recorded in <br /> Book 982 Page 67 of the records in the Recorder' s Office <br /> of Macon County, Illinois. <br /> 3 . Said tap, connection and service shall be made and <br /> installed by a licensed and bonded excavator. <br /> 4 . At such time as said premises become contiguous to the <br /> corporate limits of City, the then owner of said premises shall, <br /> within ninety (90) days after receiving notice from City thereof, <br /> petition to annex the same to the City. <br /> 5. This Agreement shall terminate upon the failure by Owner <br /> to comply with any provision hereof or with any applicable <br />
