Clark, Director of Community Development <br /> SUBJECT: Final Plat - Country Club Woods First Addition <br /> An amendment to the subject plat is scheduled for review and ac- <br /> tion by the City Council on Monday, July 15 , 1991; it was <br /> originally approved in october, 1989 . <br /> Generally located west of Robinson Avenue approximately 400 <br /> feet north of Country Club Road, the area in question is platted <br /> as four single family lots. In accordance with the approved <br /> plat, each of these lots is to have vehicular access from the <br /> newly constructed interior street (Forrest Trail) ; the plat <br /> stipulated that no vehicular access was to occur from the subject <br /> tract directly onto Robinson Avenue. <br /> The vehicular aceess to Robinson Avenue was prohibited in view of <br /> the following: (1) vehicles traveling on Robinson Avenue in ex- <br /> cess of 31 miles per hour would cause inadequate sight distance <br /> for vehicles entering and/or exiting from the subject tract ex- <br /> cept at the intersection with Forrest Trail , and (2) Robinson <br /> Avenue was not required to be improved to minimum standards for a <br /> residential street. Subsequent to approval Qf this plat, lot one <br /> was acquired and a single family dwelling has been constructed <br /> thereon. The owner was aware of the vehicular access restriction <br /> prior to construction; however, he proceeded with the present <br /> design. <br /> In discussion with the owner, staff has recommended that he ex- <br /> tend a driveway parallel to Robinson Avenue south to Forrest <br /> Trail. Further, staff noted that we would recommend the sale of <br /> a four foot strip of right-of-way along the west side of Robinson <br /> Avenue to provide additional land for the driveway. <br /> Having considered the above data, staff recommends denial of the <br /> proposed amendment. In rendering this recommendation, we note <br /> the following: (1) the original subdivision plat was approved <br /> less than two years ago, and the developer agreed to the stipula- <br /> tions as noted, (2) the current property owner (petitioner) was <br /> aware of these stipulations prior to construction of his dwell- <br /> ing, (3) a question of traffic safety would result from the <br /> proposed vehicular access on Robinson Avenue; and (4) Robinson <br /> Avenue was not required to be improved to minimum City standards <br /> in conjunction with this subdivision since there would be no <br /> direct vehicular access thereto. <br />
