R �j� v RESOLUTION EXPRESSING RESOLVE OF THE CITY OF DECATUR TO PARTICIPATE IN A STATE-WIDE ONE-CALL NOTICE SYSTEM WHEREAS, the owners and operators of underground utility facilities, except those within the boundaries of a municipality with a population of at least one million persons, are required by State statute to participate in a State-Wide One-Call Notice System; and WHEREAS, the City of Decatur is the owner and operator of such a facility which is not exclusively within the boundaries of a municipality with a population of at least one million persons; and, WHEREAS, JULIE, Inc. , (the Joint Utility Locating Information for Excavators) is the only State-Wide One-Call Notice system in operation in the State of Illinois; and, WHEREAS, the City of Decatur wishes to abide by the requirements of the State statute requiring its participation in a State-Wide One-Call Notice System. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DECATUR, ILLINOIS: Section l . That the City of Decatur shall participate in JULIE, Inc. ' s State-Wide One-Call Notice System and pay the appropriate fee for calls received from J.U.L. I .E. as a result of said participation. Notwithstanding the foregoing, the City of Decatur hereby specifically states that in so participating, it does not accept or agree to be bound by any written Agreement, Articles of Incorporation, By-laws or Operating Rules and Regulations of or with J.U.L. I .E. , Inc. unless acceptance thereof is agreed to in writing by the City. Section 2 . That the Public Works Department and the staff of the City of Decatur be, and hereby are, directed to provide all information required for participation in JULIE, Inc. , to follow all directions issued by JULIE, Inc. pertaining to the I operation of the system and to cooperate in all manner necessary to participate in the work of JULIE, Inc.
