REAL ESTATE PURCHASE AGREEMENT <br /> For and in consideration of the promises, covenants, <br /> agreements, and conditions hereinafter set forth to be performed, <br /> kept and met by the respective parties hereto, this Real Estate <br /> Purchase Agreement is made by and between FRANK H. KING AND <br /> DOROTHY A. KING, hereinafter referred to as Owners, and the CITY <br /> OF DECATUR, ILLINOIS, a Municipal Corporation, hereinafter <br /> referred to as Buyer, as follows: <br /> 1. The Owners agree to sell, and the Buyer agrees to <br /> purchase, the followinq described real estate (premises) situated <br /> in Macon County, Illinois: <br /> Government Lot 2 of the Northwest 1/4 of Section 2 , <br /> Township 16 North, Range 3 East of the 3rd P.M. , EXCEPT <br /> the East 38 . 3 acres thereof. Consisting of 54 . 02 acres, <br /> more or less. <br /> 2. Title evidence, such as a commitment for an owner' s <br /> title insurance policy insuring against defects in the <br /> merchantability of title to the value of the purchase price, <br /> shall show that there are no financing statements on file <br /> affecting any personal property or fixtures included in the <br /> purchase. Title may be subject to coal and mineral rights if now <br /> reserved or conveyed of record, and to all easements and building <br /> and use restrictions now of record which do not restrict <br /> reasonable or intended use.
