TIME OF PERFORMANCE <br /> The services of the Subgrantee are to commence upon <br /> receipt of a Notice to Proceed from the Department and <br /> shall be undertaken and completed in such sequency as to <br /> assure their expeditious completion in the light of the <br /> purposes of this Agreement and within the budget amount <br /> authorized. <br /> III . ASSISTANCE AND DATA TO EE FURNISHED TO SUBGRANTEE <br /> All information, data, reports, records, and maps as are <br /> existing, available and necessary for the carrying out of <br /> the worY. as outlined above shall be furnished to the Sub- <br /> grantee without charge by the Department. <br /> IV. USE OF FUNDS <br /> 1 . Project funds shall be used for those costs which are <br /> applicable to this Agreement. Project funds shall not be <br /> used (1) for the general administration of the Subgrantee <br /> or {2) to replace nonfederal contributions in any <br /> federally-aided undertaking where an agreement has been <br /> entered into with any Federal agency obligating such non- <br /> federal contribution with respect to such undertaYing. <br /> 2 . No project funds shall be obligated for payment of: <br /> a. Costs incurred for the Project prior to the Or- <br /> der to Proceed. <br /> b. Costs incurred with respect to any action of the <br /> Project after the Department has requested that <br /> the Subgrantee furnish data concerning such ac- <br /> tion prior to proceeding further, unless and un- <br /> til the Subgrantee is thereafter advised by the <br /> Department that there is no objection to so <br /> proceedings . <br /> c. Costs incurred after April 30, 1991, and for <br /> which no appropriation for the fiscal year en- <br /> ding on said date has been made in the budget of <br /> said Subgrantee. <br /> 3 . No member of or Delegate to the Congress of the <br /> United State, and no Resident Commissioner, shall be ad- <br /> mitted to any share or part of this Agreement or to any <br /> benefit to arise from the same . (See Exhibit A) <br />
