TIME OF PERFORMANCE The services of the Subgrantee are to commence upon receipt of a Notice to Proceed from the Department and shall be undertaken and completed in such sequency as to assure their expeditious completion in the light of the purposes of this Agreement and within the budget amount authorized. III . ASSISTANCE AND DATA TO EE FURNISHED TO SUBGRANTEE All information, data, reports, records, and maps as are existing, available and necessary for the carrying out of the worY. as outlined above shall be furnished to the Sub- grantee without charge by the Department. IV. USE OF FUNDS 1 . Project funds shall be used for those costs which are applicable to this Agreement. Project funds shall not be used (1) for the general administration of the Subgrantee or {2) to replace nonfederal contributions in any federally-aided undertaking where an agreement has been entered into with any Federal agency obligating such non- federal contribution with respect to such undertaYing. 2 . No project funds shall be obligated for payment of: a. Costs incurred for the Project prior to the Or- der to Proceed. b. Costs incurred with respect to any action of the Project after the Department has requested that the Subgrantee furnish data concerning such ac- tion prior to proceeding further, unless and un- til the Subgrantee is thereafter advised by the Department that there is no objection to so proceedings . c. Costs incurred after April 30, 1991, and for which no appropriation for the fiscal year en- ding on said date has been made in the budget of said Subgrantee. 3 . No member of or Delegate to the Congress of the United State, and no Resident Commissioner, shall be ad- mitted to any share or part of this Agreement or to any benefit to arise from the same .
