� - <br /> . <br /> EXHIBIT "A" <br /> EQUAL EMPLOYMENT OPPORTUNITY CIAUSE required by the Illino�s Feir Employment Pract�cez <br /> Commission as a material term of all public contracts: . <br /> "EQUAL EMPLOYMENT OPPORTUNITY <br /> In the e�•ent of the contractor's noncompliance «•ith any provision of this Equal Employment <br /> Opportunity Clause, the Illinois Fair Emplo�•ment Practices Act or the Fair Employment Practices Com- <br /> mission's Rules and P.egulations for Public Cont�•acts, the contractor may be declared nonresponsible <br /> and therefoi-e ineligible for future conti•acts or subcontracts ��•ith the State of Illinois or any of its poli- <br /> tical subdi�•isions or municipal corporations, and the contract may be cancelled or avoided in whole or <br /> in part, and such other sanctions or penalties ma}� be imposed or remedies invoked as provided by <br /> statute or re�ulation. <br /> Durin� the pei•foi•mance of this contr•act, the contractor agrees as follo�•s:� <br /> (1) That it «•ill not discriminate against any employee or app}icant for employment because of <br /> � race, color, religion, sex, national origin oi• ancesti•y; and fui•ther that it «ill examine all job classi- <br /> fications to determine if minority persons or ���omen are underutiliaed and «�ill take appropriate affir- <br /> mative action to rectify any such underutilization. i <br /> (2) That, if it hires additional employees in urder to perform this contract, or any portion hereof, <br /> it will determine the availability (in accordance �•iLh the Commission's R.ules and P.egulations for Public <br /> Contracts) of minorities and women in the area(s) from «�hich it may reasonably recruit and it �•ill hire <br /> for each job classification for K•hich emplovees are hired in such a w•ay that minorities and �•omen are <br /> not underutilized. <br /> (3) That, in all solicitations or advertisements foi• employees placed by it or on its behalf, it will <br /> state that all applicants �vill be afforded equal opportunity �•ithout discrimination because of race, color, <br /> religion, sex, national origin or ancestry. <br /> (�) That it ���ill send to each laboi• organization or representative of workers �•ith ��•hich it has or <br /> is bound by a collective bai-ga.ining or other agreement or understanding, a notice advising such Jabor <br /> organization or representative of the contractor's obligations under the Illinois Fair Employment Prac- <br /> tices Act and the Commission's Rules and F.egulations for Public Contracts. If any such labor organi- <br /> zation or representative fails or refuses to cooperate w•ith the contractor in its efforts to comply «•itli <br /> such Act and Rules and Regulations, the contractor «•ill promptly so notify the Illinois Fair Employment <br /> Pi-actices Commission and the contracting agency and will recruit employees from other sources �rheT� <br /> necessary to fulfill its obligations thereunder. <br /> (5) That it «•ill sul�mit reports as required by the Illinois Fair Employment Practices Commission's <br /> Rules and Regulations for Pablic Conti•acts, fui•nish all rele�ant information as may from time to <br /> time be requested by the Commission or the co►�tracting agency, and in alI respects comply �•ith the <br /> Illinois Fair Employment Practices act and the Commission's Rules and Regulations for Public Contracts. <br /> (6) That it «•ill permit access to all rele�•ant books, records, accounts and �•ork sites by personnel <br /> of the contracting ageiicy and the Illinois Fair Employment Practices Commission for purposes of.in�•es- <br /> tigation to ascertain compliance ��•ith the Illinois Fair Employment Practices Act and the Commission's <br /> Rvles and Regulations for Public Contrac�S. <br /> (7) That it «•ill include ��erbatim or by i•eference the provisions of paragraphs 1 thi•ough 7 of this <br /> clause in every performance suUcontract as defined in Section 2.10(b) of the Commission's Rules and <br /> Regulations for Public Contracts so that such pro��isions �sill be binding upon every such subcontractor; <br /> and that it will also so include the provisions of pai•agraphs 1, 5, 6 and '7 in every suppl3• subcontracl <br /> as defined in Section 2.10(a) of the Commission's P.ules and Regulations for Public Contracts so that <br /> such provisions ��•ill be binding upon e�-es•�� such subcontractor. In the same manner as K•ith other pro- <br /> �risions of this contract, the contractoi• k•ill be liable for compliance «•ith applicable pro��isions of thi� <br /> clause by all its subcontractors; and fui-ther it u•i]! promptly notify the contracting agency and the <br /> Illinois Fair Emplo}�ment Practices Commission in t1�e e�ent any subcot�tractor fails or refuses to comply <br /> there�•ith. In addition, no contractor �•ill utilize any subcontractor declared by the Commission to be <br /> nonresponsible and therefore ineligible for contracts or subcoi�tracts �vith the State of Illinois or any of <br /> its political subdi�•isions or municipal corporations." <br />
