previously constructed and lying in Arbor Drive, and as <br /> connection charges therefor, whether connection at such time is <br /> requested or not, the following sums, as indicated: <br /> Water main - $ 6,900 <br /> Sewer main - $23,475 <br /> Total $30,375 ("utility charge") . <br /> However, if the water main is extended on to the Premises with a <br /> main equal to or greater than six (6) inches in diameter, then <br /> the payment of the sum indicated herein for same shall be waived <br /> and the utility charge reduced accordingly; provided that, <br /> appropriate connection charges for individual service lines <br /> tapping into said six (6) inch or greater extension shall be <br /> assessed, as per the provisions of Chapter 65 of the City Code. <br /> 8. If a building permit is issued for less than the entire <br /> Premises, then the owner of that portion of said Premises shall <br /> be liable to the City for that fraction of the utility charge <br /> derived by multiplying said charge by that fraction equalling the <br /> total area of such portion of the Premises divided by the total <br /> area of the Premises. <br /> 9. The water main and sewer main components of the utility <br /> charge, or fraction thereof, as the case may be, shall be due and <br /> payable, and enforceable, in the same manner as water main and <br /> sewer main connection charges, respectively, as provided in <br /> Chapters 65 and 74 of the City Code. <br /> 10. The provisions of this Agreement shall supersede the <br /> provisions of any ordinance, code or regulation of the City which <br /> may be in conflict with the provisions of this Agreement. <br />
