ORDINANCE NO. 2016-51 <br /> ORDINANCE AMENDING CITY CODE <br /> -CHAPTER 52— <br /> -ALCOHOLIC LIQUOR— <br /> BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF DECATUR, <br /> ILLINOIS: <br /> Section 1. That Chapter 52 of the City Code of the City of Decatur, Illinois, be, and the <br /> same is hereby modified and amended by amending Section 36, so that Section 36 as so <br />' modified and amended, shall provide as follows: <br /> 36. LOCATION LIMITATIONS. Except as otherwise provided in Section 4 (M) of this <br /> Chapter, no license shall be issued for the sale at retail of any alcoholic liquor within five <br /> hundred (500) feet of any church or school, other than an institution of higher learning; provided <br /> that, this prohibition shall not apply to hotels offering restaurant service, regularly organized <br />� clubs, or to restaurants, food sho s or other laces where the retail sale of alcoholic li uors is not <br /> P P 9 <br /> the principal business carried on or licensed businesses located within the B-4 Central Business <br /> District . No license shall be issued for the sale at retail of any alcoholic liquor within one <br /> hundred (100) feet of any church or school, other than an institution of higher learning for <br /> licensed businesses located within the B-4 Central Business District. This rohibition shall not <br /> P <br /> apply to locations licensed on December 18, 1995, or to locations where a church or school has <br /> been established within the prohibited distance since the issuance of the most recent license. The <br /> distance shall be measured from the property boundary of the licensed premises to the property <br /> boundary of the church or school, except for premises located within the main building of a <br /> shopping center of 35,000 square feet or more in gross floor area, the distance shall be measured <br /> from the lease line of the licensed premises to the property boundary of the church or school. <br /> Section 2. That the City Clerk be, and she is hereby, authorized and directed to cause the <br /> provisions hereof to be appropriately set out in the City Code and to cause the same to be <br /> published in pamphlet form according to law. <br />
