CITY COUNCIL MEMORANDUM <br /> NO. 2016-17 <br /> July 13,2016 <br /> TO: Honorable Mayor Moore Wolfe and City Council <br /> FROM: Tim Gleason, City Manager <br /> Wendy Morthland, Corporation Counsel <br /> Amy Waks, Assistant Corporation Counsel <br /> SUBJECT: Amendment to Chapter 52—Alcoholic Liquor <br /> RECOMMENDATION: Staff requests that Council pass the proposed ordinance amendment <br /> regarding Chapter 52, Section 36, amending the language for the exemption to the distance <br /> restricting a license location for the sale at retail of any alcoholic liquor. Currently, Section 36 <br /> exempts hotels offering restaurant service, regularly organized clubs, or to restaurants, food <br /> shops or other places where the sale of alcoholic liquors is not the principal business carried on <br /> or licensed businesses located within the B-4 Central Business District from the five (500) foot <br /> limitation of any church or school, other than an institution of higher learning. Staff requests that <br /> the exemption only apply to businesses where the retail sale of alcoholic liquors is not the <br /> principal business carried on to foster and attract new, innovative businesses to the City while <br /> not altering the essential character of the locality or have a negative impact on surrounding <br /> properties. <br /> POTENTIAL OBJECTIONS: There are no known or expected objections. <br /> INPUT FROM OTHER SOURCES: None <br /> STAFF REFERENCE: Amy Waks, Assistant Corporation Counsel, at 424-2807. <br /> BUDGET/TIME IMPLICATIONS: None <br />
