III. MINORITY BUSINESS ENTERPRISE POLICY <br />�� <br /> It is the policy of the U.S. Department of Transportation that mi�ority <br /> business enterprises, as defined in 49 CFR Part 23, shall have the <br /> maximum opportunity to participate in the performance of contracts <br /> financed in whole or in part with Federal funds. Consequently� the MBE <br /> re ui rem n <br /> q e ts of 49 CFR Part 23 a 1 to hi <br /> pp y t s contract. <br /> The contractor agrees to ensure that minority business enterprises, as <br /> defined in 49 CFR Part 23 have the maximum oppgrtunity to participate in <br /> the performance of this Agreement. In this regard, the contractor shall <br /> take all necessary and reasonable steps, in accordance rith 49 CFR Part <br /> 23, to ensure that minority business enterprises have the maximum <br /> opportunit to com ete for and rf rm <br /> Y p pe o portions of this Agreement. The <br /> contractor shall not discriminate on the basis of ra <br /> ce. color, national <br /> origin, or sex in the selection and retention of subcontractors. <br /> including procurement of materials and leases of equipment. <br /> The contractor shall include the provisions of this Appendix in every <br /> subcontract, includinq procurement of materials and leases of equipment. <br /> Failure to carry out the requirements set forth above shall constitute a <br /> breach of Agreement and may result in termination of the Agreement or <br /> such remedy as deemed approprlate. � <br /> III-1 <br />
